Welcome to South Vintage! The terms “we”, “us” and “our” refer to South Vintage by Finizio Mario. South Vintage operates this store and website, including all information, content, features, tools, products, and related services, in order to offer you, as a customer, a curated shopping experience (the “Services”). South Vintage is Powered by Shopify, which allows us to provide you with the Services. The terms and conditions set forth below, together with any policies referenced herein (these “Terms and Conditions of Service” or “Terms”), describe your rights and responsibilities when using the Services. Please read these Terms and Conditions of Service carefully, as they include important information about your legal rights and cover aspects such as warranty disclaimers and limitations of liability. By visiting, interacting with, or using our Services, you agree to the application of these Terms and our Privacy Policy. If you do not agree, you must not use or access our Services.

SECTION 1 - ACCESS AND ACCOUNT

By accepting these Terms, you represent that you have reached the age of majority in your state or province of residence. You represent and warrant that all information provided (email, billing, and shipping data) is accurate, current, and complete. You are solely responsible for maintaining the security of your account credentials and for all activities that occur under your account.

SECTION 2 - OUR PRODUCTS (VINTAGE AND WARRANTY)

2.1 We have made every effort to provide an accurate representation of our products. However, colors may differ depending on the device used. 2.2 Nature of goods: We sell second-hand (vintage) clothing and accessories. As these are unique used items, any signs of wear or imperfections are inherent characteristics. 2.3 Legal Warranty (Used Goods): For consumers residing in the EU, pursuant to Art. 134 of the Consumer Code, the legal warranty on second-hand goods is limited to 12 (twelve) months from delivery. This warranty does not cover defects resulting from normal prior use or those explicitly reported at the time of purchase.

SECTION 3 - ORDERS AND AVAILABILITY (UNIQUE PIECES)

When you place an order, you are submitting an offer to purchase. South Vintage reserves the right to accept or reject the order for any reason. The order is not accepted until South Vintage confirms its acceptance. Concurrent purchases: Because the products are unique pieces, in the event of simultaneous purchases of the same item, South Vintage will cancel the unfulfillable order and provide a full refund. You declare that your purchases are for personal use and not for commercial resale.

SECTION 4 – PRICING AND BILLING

Prices, discounts, and promotions are subject to change without notice. Unless otherwise stated, prices do not include taxes, shipping costs, customs duties, or import fees (non-EU), which remain the responsibility of the buyer. You agree to update your account promptly so that we may complete transactions.

SECTION 5 - SHIPPING AND DELIVERY

We are not responsible for delays caused by carriers, customs procedures, or events beyond our control. Once the products are transferred to the carrier, ownership and the risk of loss pass to you. Free shipping thresholds are indicated on the site and may vary based on promotions or destinations.

SECTION 6 - INTELLECTUAL PROPERTY

Our Services and all content (trademarks, logos, text, images, photos) are the property of South Vintage and are protected by international intellectual property laws. Reproduction or distribution without prior written consent is prohibited.

SECTION 7 - OPTIONAL TOOLS

You may be provided with access to third-party tools that we do not monitor. You acknowledge that we provide such tools “as is” and “as available”, without any warranties.

SECTION 8 - THIRD-PARTY LINKS

We are not responsible for examining or evaluating the content or accuracy of third-party websites. Complaints regarding third-party products should be directed to the third party.

SECTION 9 - RELATIONSHIP WITH SHOPIFY

South Vintage is powered by Shopify. All sales take place directly with South Vintage. You acknowledge and agree that Shopify is not responsible for any aspect of the sales, including damages or losses arising from the products. You expressly release Shopify from any liability related to your transactions.

SECTION 10 - PRIVACY POLICY AND ODR

All personal data is subject to our Privacy Policy. Pursuant to EU regulations, the Online Dispute Resolution (ODR) platform is available here: https://ec.europa.eu/consumers/odr/.

SECTION 11 - FEEDBACK

If you submit feedback or reviews, you grant us a perpetual, worldwide, royalty-free license to use, publish, and distribute such material in any medium.

SECTION 12 - ERRORS AND OMISSIONS

We reserve the right to correct errors, inaccuracies, or omissions related to descriptions, pricing, or availability and to cancel orders at any time (including after an order has been submitted).

SECTION 13 - PROHIBITED USES

EXCEPT AS EXPRESSLY STATED BY SOUTH VINTAGE, THE SERVICES AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT ANY WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ALL IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

SECTION 17 - LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL SOUTH VINTAGE, OUR COLLABORATORS, OR SHOPIFY BE LIABLE FOR ANY INJURY, LOSS, OR DIRECT, INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGE ARISING FROM THE USE OF THE SERVICES OR ANY PURCHASED PRODUCT.

SECTION 18 - INDEMNIFICATION

YOU AGREE TO INDEMNIFY AND HOLD HARMLESS SOUTH VINTAGE AND SHOPIFY FROM ANY CLAIM OR DEMAND, INCLUDING REASONABLE LEGAL FEES, ARISING FROM YOUR BREACH OF THESE TERMS OR THE LAW.

SECTION 19 - SEVERABILITY

In the event that any provision is held to be illegal or void, such provision shall be severed from these Terms without affecting the validity of the remaining provisions.

SECTION 20 - WAIVER; ENTIRE AGREEMENT

Failure to exercise a right shall not constitute a waiver of that right. These Terms constitute the entire agreement between you and us.

SECTION 21 - ASSIGNMENT

You may not transfer your rights under this agreement without our written consent. We may assign our rights without your consent.

SECTION 22 - GOVERNING LAW AND JURISDICTION

These Terms are governed by Italian law. Jurisdiction (EU Consumers): The court of the consumer's place of residence or domicile. Jurisdiction (Others/Non-EU): Exclusive jurisdiction of the Court of Naples, Italy. Notwithstanding the application of Italian law, consumers who habitually reside in another European Union member state continue to enjoy the protection provided by the mandatory provisions of the law of their country of residence.

The section headings are for convenience only and do not affect the Terms.

SECTION 24 - CHANGES

We reserve the right to update these Terms at any time. Continued use of the site constitutes acceptance of the changes.
